View Full Version : Maid Agency threaten to recover loan amount from me

Hi Samsters,
Need your advice. My ex maid came back to Singapore to work for another household. She is damn sticky and misses me. Keeps asking me to go find her again.
So I did and was asked to go into her employer's home as she cannot go out. I refuse many times as even though both of us enjoy the sex, I find it not right to intrude into somebody's house for such thing.
However, lust got the better of me and we ended up doing in her room for a few occassions.
Now the problem is because we text constantly and her employer found out about this and naturally was furious. In the end, she has been sent back to agency. Now the point is this. Agency called me up because they are holding onto her phone. Now request me to pay up the remaining loan so that they can send her back.
The agency has told me that employer has returned the maid. They wanted to report police but have not done so. (it was a about 2 months since they found out the incident) They have all the evidence in the phone about our sexual relationship. Now if I pay up, they will return the phone to me and close the case. If I don't, they cannot send the maid back because of this outstanding loan which needs to clear.
My questions are, what are my liabilities on this? Do I have to pay or can I just ignore this. In fact, if I did not pick up the phone, they would not have been able to reach me. Granted this was my ex-maid, agency could possibly trace where I stay and my contact number. But legally they cannot force me to pay. My take is that the agency is trying to claim and minimize losses on their part. Employer is not affected unless she is no longer taking another maid.
Any advice is appreciated bros. :(

Since both of you enjoyed each other's company so much, why didn't she continue her contract with you?
Having a relationship is not against the maid's employment contract. Getting caught for traspass in the employer's home and the maid allowing the traspass is. If they have proof of this then a bit ma fan.
Why don't you sweet talk the agency to allow the maid to be transferred to another employer, better still to you. You can also get a friend to employ her and share the benefits.
Beyond that, you could also divide the amount the agency wants by the number of times you enjoyed the maid physically and treat it as post payment for her services.

Actually, from what I discussed with the agency, they want to settle it amicably. Meaning to say, I pay up the remaining loan and she goes back home.
Her employer wants to blacklist her so no choice gotta go home. But the story told to me by maid last night via sms is that she is up for transfer.
Anyway, what I want to know is that am I being blackmailed by the agency for this. Nobody wants to go the distance on this case. The employers can claim trespassing but it was their maid who let me in. So its contentious here. Which is the reason why the agency say since employer wants to blacklist her, need to send back so the loan amount is outstanding.
Once I settle, maid goes back, i get all evidence and phone back. But even if i dun settle, what can they do? I'm not saying im shrinking from this but I find it strange. What's more it isnt a small amount, about $1k.

In the eyes of the law, as long as a member of the house let's u in, it is not considered trespass... If not u would have been ask to drink kopi with the police... so don't worry about it and tell the agency to f off...

Bro, u r rite! The maid opened the door for TS to enter. Then she opened her legs for TS little brother to enter. TS din force it open. So no worry .... Dun think mata so free nothing to do meh? Maid agency just wants to recover some of their loss of earning. Maybe sticky if TS is married. If not, no worries...:D

There is nothing contentious here. I remember a similar case being reported in the Straits Times a few years back. Another maid brought her bf home and was caught on CCTV. The bf was sentenced to jail for trespassing. The maid is not a family member and has no right to decide who can enter the house.
If you fight this case, you will surely lose as there is a court precedent. If I were you, I will pay up. Anything that money can solve is a small matter. Money you can earn back. If you fight this case, you need to waste more money if it becomes a court case.
bro...u as a ADULT singaporean really got no defense for trespassing into another person house to have sex with their maid

I suggest you pay up. Trespassing is a serious offence in the eye of Singapore law (which I do not understand why)

According to Singapore's Penal Code, sub-section 448.
Punishment for house-trespass
448. Whoever commits house-trespass shall be punished with imprisonment for a term which may extend to one year, or with fine which may extend to $3,000, or with both. [51/2007][Indian PC 1860, s. 448]
Getting you to pay for the outstanding loan is letting you off easy. If I am the owner, I will make it a police case. A stranger come into my house to fuck. I have a witness (the maid) who will testify against you and I have a copy of the sms exchanged. I will want to see you end up with a criminal record and then get the judge to order you to pay the outstanding loan amount.
Maids are not family members. They do own the house or is a direct family member of the home owner. Maids are just contractors we pay on a monthly basis to upkeep our house.
You better pay up and you better do it fast. Get it in writing that the owner will not pursue the matter further once the payment has been made.

Question, if they couldnt have gotten to me in the first place, they would not be able to negotiate me to pay the loan. The fact that the employers did not report police in the first place already meant that more or less they were willing to let it rest as long as it is not repeated.
Thus this is like blackmailing me since now they are able to use trespassing as a bargaining chip now.
So if I had not answered the call or now i cancelled my line, what are the chances they will proceed with reporting jus to claim back the money?

Maybe i can enlighten you better, your case if filed at the courts will be thrown out by the judge immediately
For you to be charged with trespass you must have willfully entered the dwelling univited, in this case you were invited by the maid, hence that charge holds no water, sms conversations can be admitted into evidence
Second charge, the maid and you indulged in a sexual relationship, this relationship although sexually is not your responsibility but the responsibility of the employer, they are the grantor not you
Reason why the agency is asking for money is simply because they have now made a loss, hence are trying to recover that loss from you.
Basically you do not not have to pay the maid agency anything and infact you can tell them to go ahead to report to the police reminding them if a false police is lodged against you, it will deemed as an offence for the maid agency and her present employer as false reports are taken seriously
Even if they report to the police, the police will not do anything as they will ask the same questions as whether there was forced entry or were you invited.
The fact the maid agency called you and asked you to pay for the loan is itself an offence, as this is deemed under blackmailing and another charge under MOM regulations
Next time the maid agency call you just tell them no and if they persist you will report them to MOM and make a police report against them for blackmailing
Next time just go to hotel and avoid all issues

What should you do if you have a new maid to prevent such an occurrence?
1. Make sure you are the one locking up your house at night. Your maid should be able to leave the house in an emergency but she doesn’t need to have full access to your security system.
2. If your new helper has suspicious phone calls from men or there are signs like cigarette smoke around the house during the day, be vigilant. The maid might be allowing someone to visit her at your house.
3. If you have a new maid, don’t leave her alone with vulnerable members of your family such as young children or elderly parents. Supervise her until you are sure that she understands the rules of your house.
4. Make sure that you vary your routine. Occasionally, go home at an unusual time or have a friend that the maid knows, visit in the middle of the day. This will ensure that your maid is never too confident of having the house to herself at particular times of the day.
5. Do not leave your maid alone at home when you go on holiday if possible. Have a friend or family member house-sit for you.
As your maid is a resident at your house, if she invites someone in, even if they are a stranger to you, there is no offence. It is only if they steal from you, that the police can act. If they just enter the house, there is nothing the police can do.

Am not a lawyer, so just take whatever I posted with a huge punch of salt.
Firstly, add pointed by a Bro above, I'd there's already a precedent, then it's likely that you're gonna deemed as having trespass into the property.
However. ..
Even if there's a case, it had to be the property owner to make the police report, nor the maid agency owner. Hence, if the property owner doesn't make the report, you can assume that he doesn't want to blow up the case.
So, if the maid agency asked you again for money, you may:
1. Ignore them;
2. Warn them you may report them for blackmail.
Caveat: I'm not a lawyer, so read but make your own decision.

There was a previous case in Toa Payoh. A maid invited her ah neh bf back to her room for a session. The difference here was the ah neh climb in thru the room window as the flat was on the ground floor. A neighbour saw and thought a breakin was in progress so called the police. Police came and arrested the ah neh. But after establishing that it was not a breakin but something else. They had to let ah neh go and closed the case.
So TS dont have to pay the agency anything as there's no case for them. But can pay me some kopi $$. heehee

dont understand why this owner make life so difficult for herself.
Just return the maid to agency, which she has done. This owner can also get a new replacement maid.
Why this agency want to sent the maid back ?? The maid can be transfer to new owner. The agency dont need to pay a single cents, as the new owner will pay for all the admin..
TS need not care what agency say about he paying for her placement fees bcos this will be taken care by her new owner.

ask them for 1k to close the case and you will not pursue anymore
